 Rep. Cassell bill would tighten workers’ comp eligibility

Representative Timothy Cassell (D-Madison) is introducing legislation that will make an employee ineligible for workers’ compensation benefits if injured on the job while committing a serious crime.

 

Under the bill, a person would have to be found guilty of third-degree misdemeanor or a more serious crime to be ineligible for workers compensation benefits.

 

Rep. Cassell’s bill is in response to an incident where a truck driver caused a serious traffic accident, killing a 26-year old Cleveland Public Schools teacher.  The victim was a resident of Madison.  The driver pled guilty to charges of vehicular homicide. 

 

Rep. Cassell first learned of this tragedy from a Channel 5 news story and has been in contact with the victim’s family.  Through later research, Rep. Cassell learned that the driver filed a disability claim and is now receiving workers’ compensation benefits from the state and his employer.

 

“This is a serious flaw in the system,” said Rep. Cassell.  “People like this are manipulating the system in their favor and taking money away from those who really need it.”
